Welcome to 3DTuner. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By using 3DTuner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these terms, you may not use our service.

2. Service Description

3DTuner provides an online audio frequency conversion service ("Service") that allows users to convert audio files to different frequency tunings. The Service is provided on an "as is" and "as available" basis.

3. User Accounts and Tiers

We offer several tiers of access to our Service:

• Guest: Users who have not registered an account. Guest access is subject to limits on the number of conversions and file sizes as detailed on our website.
• Free Registered: Users who have created a free account and verified their email address. This tier offers increased daily conversion and file size limits.
• Supporter (Premium Token): Users who make a qualifying monetary contribution receive a balance of "Tokens." Conversions are deducted from this balance. This tier is not subject to daily conversion limits but is limited by the user's token balance and a specific file size limit.
• Supporter (Premium Unlimited): Users who make a qualifying monetary contribution receive unlimited conversion access for a fixed period of **one (1) year** from the date of contribution, along with the highest file size limit.

4. Contributions and Payments

Contributions for Supporter tiers can be made via our third-party payment processor, Payhip, or through select cryptocurrencies. By making a contribution through Payhip, you agree to their terms of service. All contributions are voluntary and non-refundable. For cryptocurrency contributions, rewards are applied manually after we verify the transaction. We reserve the right to change contribution amounts and their corresponding rewards at any time.

5. Definition of "One Year Unlimited" Access

The "One Year Unlimited" tier grants a single user account unlimited access to the 3DTuner conversion features for a period of 365 days from the date the contribution is successfully processed. Upon expiration, the account will revert to the "Free Registered" tier unless a new qualifying contribution is made. "Unlimited" is subject to fair use, and we reserve the right to prevent abuse of the system.

6. User Responsibilities

You agree to not use the Service to:

• Upload or process any content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Upload or transmit any material that is unlawful, harmful, or obscene.
• Attempt to disrupt or compromise the security and integrity of our website, servers, or network.

7. File Storage and Data Retention

You acknowledge and agree to our file handling policy:

• Original audio files uploaded by you are deleted from our servers immediately following the conversion process.
• Converted audio files are stored temporarily and are available for download via a unique link for a period of **twenty-four (24) hours**.
• After 24 hours, converted files are automatically and permanently deleted from our servers. We are not responsible for any loss of data. It is your responsibility to download and save your converted files promptly.

8. Limitation of Liability

To the maximum extent permitted by law, 3DTuner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Service.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated terms on this page. Your continued use of 3DTuner after such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States of America, without regard to its conflict of law principles.
